1. About these terms

These Website Terms and Conditions govern your use of the HIG website and any website-based tools or information made available through it.

 

The website is operated by Home Improvements Guarantee Limited ("HIG", "we", "us" or "our"), a company registered in England and Wales under company number 08059338, with its registered office at 7 Battersea Square, London, SW11 3RA.

 

These terms do not replace or amend any separate contractor membership agreement, job-registration terms, homeowner-contractor contract, guarantee, deposit-protection arrangement, insurance policy or other contractual document. If separate terms apply to a particular service, those terms will govern that service.

 

2. Acceptance of these terms

By accessing or using the website, you agree to comply with these terms. If you do not agree, you must not use the website.

 

If you use the website on behalf of a company or other organisation, you confirm that you have authority to accept these terms on its behalf.

 

3. What the website does

The website provides information about HIG and the Home Improvement Guarantee membership scheme. It may also help homeowners identify or obtain information about participating contractors and may provide access to website-based enquiry, registration or verification tools.

 

The website itself does not create:

  • a contract for building or home-improvement works;

  • a guarantee or warranty;

  • an insurance policy;

  • a deposit-protection arrangement; or

  • any other contractual entitlement, unless expressly confirmed in separate binding documentation.

 

Any guarantee, deposit-protection or insurance-backed product referred to on the website is subject to its own eligibility requirements, terms, exclusions and documentation. It will only take effect if it has been properly applied for, accepted, registered and issued through the authorised process.

 

4. HIG's role

HIG is not an insurer, underwriter, financial institution, government body or government-backed scheme unless expressly stated in separate documentation and legally applicable.

 

References on the website to guarantees, insurance, underwriting partners or related products must not be interpreted as making HIG responsible for obligations that belong to an insurer, underwriter, contractor or other separate organisation.

 

5. Contractor membership and listings

Contractor membership is subject to HIG's application, evidence-checking and approval process. HIG may decline, suspend, restrict or withdraw membership in accordance with the applicable membership terms and its operational procedures.

 

Membership or inclusion in a directory does not, by itself, guarantee that a contractor:

  • will perform every project to a particular standard;

  • will remain financially solvent;

  • will remain available or continue trading;

  • will continue to satisfy every membership requirement; or

  • is suitable for a particular project or homeowner.

 

Where HIG provides contractor information or verification details, users should consider the date, scope and limitations of the information supplied. Users should also carry out their own enquiries and obtain suitable quotations, references, contractual documents, insurance evidence and professional advice where appropriate.

 

6. The homeowner's contract

Unless expressly stated otherwise in binding documentation, the contract for home-improvement works is between the homeowner and the contractor.

 

HIG is not a party to that contract merely because the contractor is an HIG member, appears on the website, uses HIG services or registers a job with HIG. The contractor remains responsible for the works and for complying with the terms of its contract with the homeowner.

 

7. Information and reliance

We aim to keep website information reasonably accurate and current. However, information may be supplied by contractors, insurers, underwriting partners or other third parties, and we cannot guarantee that all information will always be complete, accurate, current or available.

 

Website information, contractor profiles and verification tools are provided to assist users. They are not a substitute for appropriate enquiries, quotations, written contracts, insurance checks, professional advice or project-specific due diligence.

 

You are responsible for deciding whether a contractor, product or service is suitable for you and your project.

8. Acceptable use

You may use the website only for lawful personal or business purposes connected with the services and information provided by HIG.

 

You must not:

  • use the website in breach of any applicable law or regulation;

  • attempt to gain unauthorised access to the website, its systems or another user's information;

  • introduce viruses, malware, malicious code or other harmful material;

  • interfere with the operation, security or availability of the website;

  • scrape, harvest, copy or collect data in breach of applicable law or these terms;

  • impersonate another person or misrepresent your identity or authority; or

  • use website content in a misleading, defamatory, unlawful or unauthorised way.

 

We may suspend or restrict access where we reasonably believe that the website has been misused or these terms have been breached.

 

9. Intellectual property

Unless otherwise stated, the website design, text, branding, logos, graphics, databases and other HIG-created content are owned by HIG or licensed to HIG. All rights are reserved.

 

You may view the website and print or download reasonable extracts for your own legitimate, non-commercial use. You must not reproduce, modify, distribute, commercially exploit, publish, frame, create derivative works from or misrepresent HIG content without our prior written permission, except where permitted by law.

 

Contractor-supplied content may belong to the relevant contractor or another rights holder. Its use remains subject to the applicable rights and permissions.

 

10. Third-party links and services

The website may contain links to or information about contractors, insurers, underwriting partners and other third-party websites or services.

 

A link or reference does not mean that HIG endorses the third party or accepts responsibility for its content, availability, security, privacy practices, products, services or contractual terms. You should review the relevant third-party terms and privacy information before using a third-party service or entering into an agreement.

 

11. Website availability and changes

We may update, suspend, withdraw or restrict all or part of the website for operational, security, legal or commercial reasons. We do not guarantee that the website, its content or every feature will always be available, uninterrupted, secure or error-free.

 

We may update the website and these terms from time to time. The version displayed on the website will apply from its stated last-updated date. Changes to a separate membership, guarantee, insurance or other contract will be governed by that contract.

 

12. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

 

Subject to the paragraph above, the website and its content are provided for general information and on an “as available” basis. To the fullest extent permitted by law, HIG does not guarantee that the website or its content will be complete, accurate, uninterrupted, secure or free from errors or harmful elements.

 

Subject to any rights and protections that cannot lawfully be excluded or limited, HIG will not be responsible for:

  • the acts, omissions, performance, solvency or conduct of any contractor or other third party;

  • building works, products, services, guarantees, policies or arrangements supplied under a separate contract;

  • loss arising from your decision to rely on website information without carrying out appropriate checks; or

  • indirect or consequential loss arising from your use of, or inability to use, the website.

 

This clause applies only to use of the website and does not replace or limit any rights or obligations under a separate guarantee, insurance policy, membership agreement, consumer contract or other binding document. Nothing in these terms affects statutory consumer rights.

 

13. Privacy and cookies

We handle personal information in accordance with our Privacy Policy.

The website may use cookies and similar technologies. Please refer to our separate Cookie Policy and cookie notice for information about the technologies used and the choices available to you.

 

14. Governing law and jurisdiction

These terms are governed by the law of England and Wales.

 

If you are a consumer, you may also benefit from any mandatory protections and rights available under the law of the part of the United Kingdom in which you live. Nothing in these terms prevents you from bringing proceedings in a court that has jurisdiction under applicable law.

 

Subject to those mandatory rights, the courts of England and Wales will have jurisdiction over disputes arising from or connected with these terms.

 

15. Severability and no waiver

If any provision of these terms is found to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed only to the extent necessary, and the remaining provisions will continue to apply.

 

A failure or delay by HIG to exercise a right or remedy does not constitute a waiver of that right or remedy.
